1. Acceptance of these Terms
By accessing or using the Service, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you use the Service on behalf of a building, body corporate or organisation, you confirm that you are authorised to accept these Terms on its behalf.
2. Eligibility and accounts
- You must provide accurate information and keep your account details up to date.
- You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
- Access to certain features depends on your role (for example resident, administrator, employee or security) and on permissions granted by your building administrator.
- Notify us promptly if you suspect any unauthorised use of your account.
3. Acceptable use
When using the Service, you agree not to:
- Break the law or infringe the rights of others;
- Post content that is unlawful, harmful, misleading, harassing or offensive;
- Attempt to gain unauthorised access to accounts, systems or data;
- Interfere with, disrupt or place undue load on the Service or its infrastructure;
- Misuse personal information you access through the Service; or
- Use the Service to send spam or unsolicited marketing.
4. Community content
Listings, announcements, messages and other community content are provided by users. You are responsible for the content you post, and you confirm you have the right to share it. We do not verify, endorse or guarantee the accuracy, quality, safety or legality of user content.
You retain ownership of the content you submit. By posting, you grant us a limited, non-exclusive licence to host, store and display that content solely to operate and provide the Service. We may remove content that we reasonably believe violates these Terms or the law.
5. Roles, access and building administration
UnityProp is a role-based platform. Building administrators, owners and their agents may control access, invite or remove users, and manage building-specific settings. Some information you provide may be visible to authorised users within your building as needed for property management, as described in our Privacy Policy.
6. Your building’s agreement
Where the Service is made available to you through your body corporate, homeowners association or managing agent, our agreement is with that Scheme. The Scheme decides which residents are invited, what information it loads, and how long it keeps it. For personal information the Scheme processes in the platform, the Scheme is the responsible party under POPIA and we act as its operator, as described in our Privacy Policy.
7. Visitor passes and on-site conduct
Features such as visitor passes, parking and access control are tools to assist building management; they do not replace your own judgement or a building’s security procedures. You are responsible for how you use these features and for the guests and vehicles you authorise. On-site safety and conduct remain the responsibility of residents, visitors and building management.
8. Third-party services
The Service relies on third-party providers (for example hosting, authentication and communications) and may link to third-party websites or services. We are not responsible for the content, policies or practices of third parties, and your use of them may be subject to their own terms.
9. Intellectual property
The Service, including its software, design, branding and content (excluding user content), is owned by UnityStack (Pty) Ltd or its licensors and is protected by applicable laws. We grant you a limited, non-exclusive, non-transferable and revocable licence to use the Service for its intended purpose. You may not copy, modify, distribute, reverse-engineer or create derivative works from the Service except as permitted by law.

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use and protect personal information. Please review it to understand our practices.
11. Disclaimers
Please read this section and section 12 carefully. They limit our liability to you and contain an indemnity. Nothing in these Terms limits any right you may have under the Consumer Protection Act, 2008, or excludes liability that cannot lawfully be excluded.
The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free or completely secure, or that any content is accurate or reliable.
UnityProp is a record-keeping and communication tool. It is not a security service, and we do not warrant that use of the Service will prevent any security incident, loss or damage at any building.
12. Limitation of liability and indemnity
To the fullest extent permitted by law, UnityStack (Pty) Ltd and its owners, operators, employees and partners will not be responsible for any loss, injury, damage or harm (including to you, your person, your property, or any third party) arising from or related to your use of the Service, except to the extent such loss arises from our gross negligence or wilful misconduct or to the extent such liability cannot lawfully be excluded or limited. This includes interactions with other residents or visitors, reliance on content, or any on-site incidents.
To the extent liability is not excluded, the total aggregate liability of UnityStack (Pty) Ltd to you arising out of or in connection with the Service is limited to the greater of R1,000 and the amounts you personally paid us for the Service in the 12 months preceding the event giving rise to the claim.
You agree to indemnify and hold harmless UnityStack (Pty) Ltd and its owners, operators, employees and partners from any claims, liabilities, damages, losses and expenses arising from your use of the Service or your violation of these Terms.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
13. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required for security or legal reasons, or if directed by your building administrator. On termination, the provisions that by their nature should survive (such as disclaimers, limitation of liability and indemnity) will continue to apply.
14. Changes to the Service and these Terms
We may update, add to, or discontinue features of the Service at any time. We may also update these Terms from time to time; the “Last updated” date will be revised, and your continued use of the Service after changes take effect means you accept the updated Terms.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa, without regard to conflict-of-law principles. You agree to the jurisdiction of the South African courts for any dispute arising from these Terms or your use of the Service. Where possible, we encourage you to contact us first so we can try to resolve any issue directly.
